What is the TCSP license?
Under the Anti‐Money Laundering and Counter‐Terrorist Financing Ordinance in Hong Kong (“the AMLO”), a person, except qualified legal professional and accounting professional, is required to obtain and maintain the Trust or Company Services Provider license to offer trust or company service business in Hong Kong. The Company Registry in HK (“CR”) is the authority to administrate the legislation related to the TCSP.
What does “trust or company service business” mean?
- forming corporations or other legal persons;
- acting, or arranging for another person to act—
- as a director or a secretary of a corporation;
- as a partner of a partnership; or
- in a similar position in relation to other legal persons;
- providing a registered office, business address, correspondence, or administrative address for a corporation, a partnership, or any other legal person or legal arrangement;
- acting, or arranging for another person to act—
- as a trustee of an express trust or a similar legal arrangement; or
- as a nominee shareholder for a person other than a corporation whose securities are listed on a recognized stock market.

To fulfill these requirements, TCSP licensees are required to implement proper procedures in customer’s due diligence, customers monitoring, customers risk assessment, record keeping, and reporting of suspicious transactions. TCSP licensees are the point of contact of the law enforcement units in Hong Kong in relation to the investigation regarding the AML/CTF.
