Singapore’s Ministry of Manpower (MOM) requires only the Singapore employers can apply for EP for their foreign employees to work and stay in Singapore for the employer; the applicant, i.e., employer, must be a locally-incorporated Singapore needs to hire an employee from overseas; the candidate, i.e., the employee, must fulfill all requirement as follows:

• Have a job offer in Singapore.
• Work in a managerial, executive, or specialized job.
• Earn a fixed monthly salary of at least $3,600 (more experienced candidates need higher wages).
• Have acceptable qualifications, usually a good university degree, professional qualifications, or specialized skills.

For the foreign entrepreneur, executive, and managing director of a Singapore company, they should have not only the motivation to stay in Singapore to manage their company operations, but also relevant skills, educational qualifications, professional background, and work experience to the job. In other words, the MOM evaluates if the candidate is the right person to fulfill this job under the aspects as follows:

• The candidate is capable of satisfying the scope, duties, and responsibility of the job position of the application.
• The candidate has relevant experience or skillsets which are not commonly available in the Singapore human resources market.
• The candidate is not competing with the Singapore local workforce.
• The candidate’s salary is commensurate with the skills and experience in the field of the employer’s industry.

The MOM examines not only the employee in every EP application but also the employer’s capacity. The chance of approval is favorable if the company can show the following:

• The applicant and its foreign owners should have a proven financial track record to show the corporation is expanding in business volume.
• The applicant and its foreign headquarters is a well-structured entity and has solid substances such as office premises, long-term staff, sales and purchase records as proof of business.
• The applicant should maintain adequate paid-up in its Singapore company to support its business expenses such as payrolls.

Besides, the Singapore Government has preferences for the applicants who will contribute to the advancement of Singapore, and an application will receive higher priority if it can:

• Promote the development of science and technology-related industries and skill sets among the local workforce in Singapore.
• Build the national name and fame of Singapore.

As you are the owner of your Singapore subsidiary, you are representing the employer (applicant) and employee (candidate). Provide for the following required documents which will be submitted to the MOM:

• the passport and (if any) Singapore work pass/ student pass/ any other pass
• the higher education certificates
• resume/ CV and (if any) working testimonial
• any details relating to the criteria (e.g., financial statement, business plan, testimony, employment contract)
• the application form

Usually, the processing time of the government is for five weeks. Upon approval, the MOM issues an In-Principle Approval letter, which needs you to complete the registration in Singapore within six months. The EP is valid for one or two years period, and renewable by the expiry, given that the same employer continues the employment. Remember that each EP application ties the employer and employee together.
